The following Terms and Conditions (“Agreement”) form a legally binding contract between you (“Doctor”) and TruAlign SMC Pvt. Ltd. and are in effect as of the date of receipt of your order, as applicable. It is the Doctor’s responsibility to review and understand these terms and conditions before downloading any materials, submitting patient records or placing orders. The Doctor and TruAlign SMC Pvt. Ltd. may be individually referred to as a “Party” or collectively as the “Parties”.
1. Introduction
TruAlign produces a series of customized removable, medical grade clear polymer devices (“aligners”) designed to either maintain teeth in their current position or gradually shift them from their original alignment to a more optimal position. When treating both arches, a pair of aligners (one per arch) constitutes a single “aligner”. In single-arch treatments, each aligner represents one stage. Aligners may be delivered in full or in segments, called “batches,” depending on treatment needs. There are two types:
- Active Aligners: Designed to move teeth by applying targeted pressure.
- Retainers (Passive Aligners): Designed to maintain the teeth’s current position.
2. Case Submission and Payment Schedule
Cases can be submitted via http://www.mytrualign.com or with a physical form. Submission authorizes TruAlign to charge the relevant fee. The applicable stage wise charges are as follows:
- Stage 1: Submission of records including intraoral scan, photographs, radiographs and consent form via Trualign representative mandates a charge of 10% of the highest applicable fee
- Stage 2: Two working days after stage 1, once the Virtual Setup is completed, Trualign is eligible to retain 30% of the total fee to cover incurred costs.
- Stage 3: After the Virtual Setup is approved by the Doctor and manufacturing has started, Trualign may retain 100% of the fee.
- All stage-wise charges are nonrefundable and subject to the current/prevailing price list at the time of case submission.
- Payment for all products and fees is due from Doctor within thirty (30) days of invoice date.
- TruAlign reserves the right to request payment in advance from Doctor.
- To the extent any product made by TruAlign is subject to GST, the price for that product will be increased by an amount equal to GST payable.
- Additional fees may apply if a shipping method is requested other than TruAlign’s standard shipping procedure.
- TruAlign does not accept payments from patients, including payments in the patient’s name forwarded by Doctor.
- Prices and other terms & conditions are subject to change by TruAlign without prior notice (but will not be varied with respect to a particular order once such order has been placed)
3. Treatment Options and respective Payment Plans
Trualign offers various treatment options:

Note: Extraction cases will be categorized as TruAlign- Premium/ TruAlign- Premium+ Retainers are provided after post-treatment photos are submitted.
Refinements are included in TruAlign- Premium/ TruAlign- Premium+but can also be purchased separately.
4. Open and Closed Cases
Cases are considered “closed”;
- When the Doctor requests for a final retainer
- After 30 days of submission of records
5. Revisions
Doctors can request revisions during active cases by submitting a revision form either physically or via portal, potentially including new impressions/intraoral scans. Additional costs may apply.
If revisions extend treatment beyond original steps, the case must be upgraded or additional aligners purchased. Aligners shipped prior to revision count toward the total. Notify Trualign early to prevent unnecessary shipments.
6. Restrictions
Restrictions pertaining to all case categories include:
- Aligners will not be made for closed cases.
- Closed cases cannot be reopened; a new case submission is needed.
- Doctor must only request aligners necessary for the approved plan.
- Trualign may reject revisions/refinements if instructions were not followed or the treatment plan changed.
- Abuse of these policies may lead to cancellation without refund.
7. Validity
Each aligner is valid for 10 days of wear (22 hours/day). The Doctor must ensure patient compliance as per Trualign protocols. Any issues must be reported within the case validity period.
8. Required Records
For Aligner Treatment:
- Upper/lower PVS impressions or intraoral scans
- Bite registration (PVS) or scan
- Intraoral photos (frontal in occlusion , right and left buccal views in occlusion , upper and lower occlusal)
- Extraoral photos (frontal at rest, frontal smiling, right lateral profile at rest, right oblique view at rest)
- X-rays (OPG and Lateral Cephalogram)
All records submitted by Doctor to TruAlign becomes the property of Trualign and will not be returned. Doctor must obtain patient consent to submit records to TruAlign. TruAlign is not responsible for inaccurate or low-quality records. Records like impressions and intraoral scans require inspection and may be rejected by TruAlign if found unsatisfactory. If they are rejected, replacement records will be requested.
9. General Risks
TruAlign reminds each Doctor of their professional obligation to ensure that each patient is dentally and periodontally stable and free of any known contraindications prior to commencing treatment.
The use of TruAlign product(s) or service(s) may involve various risks, many of which are general in nature—such as health and hygiene risks—that can occur even without orthodontic treatment or that are commonly associated with traditional orthodontic treatments.
Failure to wear the appliances for the prescribed number of hours daily, not following the Doctor’s instructions, missing scheduled appointments, and the presence of erupting or unusually shaped teeth may prolong treatment duration and impact the ability to achieve the intended outcomes.
Patients may experience irritation or scratches on the gums, cheeks, or lips.
Teeth may shift position following treatment. Consistent retainer use at the conclusion of treatment helps minimize this tendency.
Tooth decay, periodontal disease, gum inflammation, or permanent markings (such as decalcification) may develop if patients consume sugary foods or drinks, fail to properly brush and floss before wearing TruAlign products, or neglect appropriate oral hygiene and preventive care.
The aligners may temporarily affect speech, potentially causing a lisp, though such speech changes typically resolve within one to two weeks.
Wearing aligners may cause temporary increases in saliva production or dry mouth; certain medications may exacerbate these effects.
Attachments may be bonded to one or more teeth during treatment to aid in tooth movement or appliance retention and will be removed once treatment is complete.
Attachments may occasionally become dislodged and require replacement.
Interproximal recontouring or slenderizing of teeth may be necessary to create the space required for proper dental alignment.
The bite may change during treatment, which can result in temporary discomfort for the patient.
In rare cases, minor surface wear of the aligners may occur in areas where patients grind their teeth or where teeth contact each other; this generally does not compromise the overall integrity or strength of the aligner.
Occlusal adjustments (bite corrections) may be needed at the conclusion of orthodontic treatment.
The presence of atypically shaped, erupting, or missing teeth may affect how well the aligners fit and may impact the ability to achieve the desired results.
Treating severe open bites, pronounced overjets, mixed dentition, or skeletally narrow jaws may require additional treatment beyond aligner therapy.
More complex treatment plans may necessitate supplemental orthodontic procedures, including the use of bonded buttons, orthodontic elastics, auxiliary appliances or dental devices (such as temporary anchorage devices or sectional fixed appliances), and/or restorative dental work, as aligners alone may not suffice to achieve the intended outcomes.
Teeth that have been overlapped for extended periods may lack gingival tissue beneath the interproximal contact after alignment, resulting in the appearance of a “black triangle” space.
Aligners are not effective for moving dental implants.
General medical conditions and/or medication use may influence orthodontic treatment. The health of the bone and gums supporting the teeth may be compromised.
Oral surgery might be required to address crowding or significant jaw imbalances present before beginning TruAlign treatment. Risks associated with anesthesia and proper healing must be considered prior to proceeding.
Teeth previously subjected to trauma or extensive restoration may be aggravated during treatment. In rare instances, this may shorten the tooth’s lifespan, necessitate additional dental procedures such as endodontic treatment or further restorative work, or lead to tooth loss.
Existing dental restorations, such as crowns, may become loose or dislodged and require re-cementation or, in some cases, replacement.
Teeth with short clinical crowns may pose challenges for appliance retention and may limit tooth movement.
Orthodontic treatment may cause shortening of the tooth roots, which can threaten the long-term viability of the teeth.
Product breakage is more likely in patients with severe crowding or multiple missing teeth.
Orthodontic appliances or components thereof may be accidentally swallowed or inhaled.
In rare cases, temporomandibular joint (jaw joint) problems may develop, resulting in joint pain, headaches, or ear issues.
Allergic reactions may occur.
Teeth not at least partially covered by the aligner may experience supraeruption (excessive eruption).
In rare instances, patients with hereditary angioedema (HAE), a genetic disorder, may experience rapid localized swelling of subcutaneous tissues, including the larynx. HAE can be triggered by minor stimuli, including dental procedures.
10. Aligner Shipment and Delivery
After complete case records and payment are received, Trualign will send/email the virtual setup within 3 working days and upload the same on TruAlign portal Aligners are only fabricated once the setup is approved. Estimated delivery is within 14 working days from approval. TruAlign will not be liable for any damages, losses or expenses incurred by Doctor if TruAlign fails to meet the estimated delivery dates.
One-time shipping within Pakistan is included. Doctor covers the cost of sending additional records required for case revisions. TruAlign will make reasonable efforts to contact Doctor within 4 days of order receipt if the order submission is not complete or all materials are not received. Incomplete order submissions will result in delays in manufacturing and shipping of products. Upon shipment, all aligners and retainers are nonreturnable, and fees are non-refundable.
11. Product Use and Doctor Responsibility
Doctor warrants to TruAlign SMC Pvt. Ltd. that:
- They are licensed to practice dentistry/orthodontics in the relevant jurisdiction.
- They are trained and qualified to use Trualign products.
- All usage of TruAlign aligners complies with medical and dental standards and Trualign protocols.
- Informed consent has been obtained from each patient treated by the Doctor using TruAlign aligners.
- They consent to Trualign’s use of patient data for educational/research purposes.
- They are fully responsible for reviewing and approving treatment plans to decide if TruAlign products and/or treatment options are suitable for a particular patient, intended use, or application. The Doctor is also responsible for diagnosing and treating each patient, as well as for the outcome of the treatment.
- TruAlign may require Doctors to submit feedback regarding a patient’s treatment upon treatment completion.
- Their approval of the customized Treatment Plan is considered a prescription and final authorization to TruAlign to manufacture the aligners.
12. Warranties & Disclaimers
Trualign warrants its products conform to the specifications provided by Doctor when submitting a case. Trualign is not liable for:
- Misuse, neglect, or third-party alterations
- Usage with other non-Trualign third party products
- Errors in Doctor-provided instructions or records
Warranty is valid for 90 days post-shipment. If warranted, Trualign may replace products. Replacements are also covered for 90 days. Other implied warranties including any warranty of merchantability or fitness for any specific purpose are disclaimed.
13. Limitation of Liability
Under no circumstances shall TruAlign be held liable for any incidental, indirect, exemplary, punitive, or special damages arising from or related to this Agreement or the use of the products provided under it, regardless of the cause and under any legal theory, whether based on negligence, breach of warranty, strict liability, contract, tort, indemnity, or any other legal or equitable theory. Such excluded damages specifically include, but are not limited to, loss of profits, loss of use, and the cost of replacement or substitute products.
Furthermore, TruAlign’s total cumulative liability for any and all damages arising out of or in connection with this Agreement, or the use of any products provided under it, shall in no event exceed the total amount actually paid to TruAlign by the Doctor for the specific products under this Agreement that gave rise to the claimed damages or losses. The existence of multiple claims relating to the same products sold under this Agreement, the existence of multiple agreements with the Doctor, or the sale of additional products to the Doctor shall not increase or extend the above-stated liability limit.
All claims against TruAlign and TruAlign employees or officers based on the failure of TruAlign products to achieve a successful or desirable outcome or injury to a patient, either alone or in combination with other treatment appliances are hereby waived by Doctor.
14. Indemnification
The Doctor agrees to fully indemnify, defend, and hold TruAlign—along with its officers, employees, agents, contractors, successors, and assigns—harmless from any and all claims, liabilities, obligations, losses, actions, demands, suits, damages, penalties, fines, and associated costs or expenses, including attorneys’ fees, arising under any legal theory (each referred to as a “Claim”). This obligation applies to any Claim brought against TruAlign that stems from, is connected to, or results from any of the following:
(i)The terms of this Agreement or the use of any products supplied under it;
(ii)The Doctor’s breach of, or failure to comply with, any provision of this Agreement;
(iii) Any actual or alleged breach of representations or warranties made by the Doctor under this Agreement, or any inaccurate or misleading information provided by the Doctor or the Doctor’s patient to TruAlign;
(iv) The provision or non-provision of products of TruAlign, except in cases where such action or inaction results from the willful misconduct or gross negligence of TruAlign
(v)Dealings with national regulators, licensing or professional bodies in relation to Doctor’s or thier practice;
The Doctor’s duty to defend TruAlign against a Claim is independent of, and in addition to, the duty to indemnify. The Doctor has both the right and the responsibility to assume control of the defense of any such Claim, using legal counsel of the Doctor’s choosing, provided such counsel is reasonably acceptable to TruAlign. TruAlign, however, retains the right to have its own legal counsel participate in the defense, at its own expense.
If a Claim is filed jointly against both the Doctor and TruAlign, and legal counsel for TruAlign determines in writing that a conflict of interest exists—such that under applicable ethical or legal standards, the same legal representation cannot be provided to both parties—then the Doctor shall not be permitted to assume the defense on behalf of TruAlign for that Claim.
15. Independent Contractors
The Parties expressly agree that the Doctor, including the Doctor’s employees, agents, and representatives, shall not be regarded as employees, agents, joint venturers, or partners of TruAlign.
This Agreement shall not be interpreted as creating any form of employment relationship between the Parties.
Neither Party has any express or implied authority to act on behalf of the other, create obligations, assume responsibilities, or legally bind the other Party in any way.
16. Assignment
Neither party may assign this Agreement without the other’s written consent.
17. Successors and Assigns
This Agreement is binding upon the Parties and their permitted successors and assigns and shall not be for the benefit of any other person, persons or legal entities.
18. Entire Agreement & Amendments
This Agreement, together with TruAlign Diagnostic and Treatment Form and the Informed
Consent & Agreement, constitutes the complete and exclusive agreement between the Parties and replaces any and all prior discussions, negotiations, correspondence, understandings, or agreements related to the subject matter contained herein. No modification or amendment to this Agreement shall be valid unless made by an authorized representative of Trualign.
19. Severability
If any provision of this Agreement is, or is found to be, in violation of any applicable law, rule, or regulation, such invalidity shall not render the entire Agreement void, nor shall it affect the validity or enforceability of the remaining provisions. Instead, the Agreement shall be interpreted and enforced in a manner that complies fully with all applicable laws, rules, and regulations.
20. Force Majeure
TruAlign shall not be considered in default or breach of this Agreement due to any failure or delay in performance, whether directly or indirectly caused by circumstances beyond its reasonable control. Such circumstances include, but are not limited to: fire, explosion, labor strikes, freight embargoes, acts of God, war, civil unrest, actions or directives of any governmental authority (whether de jure or de facto), labor shortages, transportation delays, extreme weather conditions, failure or default of a manufacturer or supplier, quarantines or other restrictions, epidemics, catastrophes, or the absence of timely instructions or essential information from the Doctor or any third party.
21. Notices
All notices, demands, requests, approvals, and other communications made or given under this Agreement must be in writing. Such communications shall be considered effective on the date they are delivered in person or sent by certified mail (postage prepaid, with return receipt requested), or on the date of transmission if sent by facsimile or electronic mail. All communications to the Doctor shall be via TruAlign portal or email.
22. Waiver
The failure of either Party to demand performance of any provision of this Agreement at any time shall not be construed as a waiver of that Party’s right to enforce such provision at a later time.
Furthermore, any waiver by either Party of a condition or of a breach of any term, provision, agreement, entente, or warranty set forth in this Agreement shall not be interpreted as a continuing or future waiver of the same condition or breach. Nor shall it be considered a waiver of any other condition or of the breach of any other term, provision, agreement, entente, or warranty contained in this Agreement
23. Governing Law
This Agreement is governed by and construed and interpreted in accordance with the laws of Pakistan. Disputes shall be resolved through arbitration, with arbitrators appointed by each Party.
